FCC Fines Fax.com $5.38 Million For Junk Faxes

The FCC has decided to fine Fax.com $5.38 million, claiming they violated anti-unsolicited fax laws repeatedly. Apparently, the FCC had warned the company a number of times, and Fax.com kept at it. It'll be interesting to see how the company responds. It's still never been made completely clear to me why we can't just make anti-junk fax laws cover spam as well.

    It's much easier to trace and prove where a fax was sent from. An email, sent from a fictitious address, relayed thru several open servers, etc., etc, is, well, you get the picture...

    The reason that Fax SPAM is illegal is the actual physical cost that is tied to receiving a fax. You need paper and toner (or ink) to receive a fax, so every fax you receive actually costs you money as well as time.
    Receiving a SPAM e-mail only costs you time, and even though most people will tell you that time = money, there isn't a convenient way to prove it.
    If you had some bizarre e-mail appliance that would receive all your e-mail and print them out before you could read them, then you might be able to get Congress to consider making the same law apply...

    For some reason this makes me smile. Perhaps it's because I receive several fax spams daily asking me if I need to replace my toner. Go get'em FCC.

    This is the second FCC judgement against them, they refuse to pay and the FCC doesn't have that many teeth to enforce it.

    they're also one fo the 2 companies (american blastfax is the other) who suceeded in getting the TCPA declared unconstiutuional.

    They have court cases going in California which are attempting to invalidate the TCPA under state law.

    _AND_ They're email junkmailers

    _AND_ They're prerecorded message phone spammers

    _AND_ the local sherrif office in California _REFUSES_ to serve summons on them. They treat each request as being party to ongoing organised harrassment of fax.com

  • Unsolicited Fax harassment

    A company called "Market Watch sends me 6 or 7 real junk fax
    every month. The "FAX REMOVAL" number is erroneous:
    1-800-410-1628.

    I went onto their website (www.alldeepblue.com) the second
    site is unreadable.

    This is costing me time, money, and high bloodpressure. I am
    80 years old and the pressure of the cost in time and funds, not
    to count the time it takes to go to Office Depot for new Fax
    machines supplies....

    How might I get them to STOP. This is being done to me
    out of spite.
