Plenty of eBay users have stories about situations when they clashed with someone at the other end of a transaction, whether it was over the terms, something misleading in the description or some other point. However, it appears that some eBay buyers have come across an amazingly angry eBay seller -- who seemed to turn nasty with no provocation at all. When potential buyers emailed him with questions, he turned around and sent them incredibly angry and threatening emails, and then started calling and harassing the buyers (who apparently left their phone numbers). The threatened buyers complained to the police, who did nothing, but a news organization tracked down the guy who claimed that if he got upset at potential buyers, it was only because they threatened him first. While it may not reach the level of showing up at an eBay seller's house with a gun, it's worth remembering that you never quite know who you're dealing with at the other end of an online transaction.

Most sellers are polite and will answer questions - yes - even ones already answered in the description. Hey, even stupid people with stupid questions have money. Answer the question and you might get a sale.

ebay if fraud, charges money for nothing
I listed a book for sale in ebay. Without a problem they listed the book and now, ebay is asking for money and charging 15% late fee per month. I am trying to contact them and they dont have phone contact. they expect me to just pay because they want money. If they charge money then in the first pleace why did they list without collecting the money. It is ebays problem or bug in the system.

Uhhh.... if you list something you have to pay for it, even if it doesn't sell. On the page you used to list the book, the very last thing they show you is the "listing fee". Just pay the bill and move on. What is it anyhow, $3? Wow, I thought I was a chpsk8!

Uhhh...$3.00 or $300.00... so what..? I'm just wondering why a company that deals with the public can't be contacted by telephone. Try getting Paypal on the horn when they screw u around. People should be raising hell over that. But no one cares so long as their ox aint being gored. God, I love humanity.

It's easy to get the corporate headquarters number for a public corporation. For ebay, check out Yahoo's ebay profile. I'm sure the operator there will be able to direct your call to the appropriate department.

On July 16th, 2005 Dwayne Schimke, ebay user ‘Turnedtwo’ contacted me about a bike I was selling on eBay. He emailed saying that he wanted to come to my home and pick up the bike. I have clearly stated in all of my auctions that I do not allow people to pick up items. He admits himself that he ‘didn’t read the whole auction’ After a few emails were exchanged I told him I had blocked him from bidding, and asked him not to email me anymore. He was offended that I forbid him to bid on my auction, and continued to email me several more times after I had asked him to stop emailing me. After that, he did not email me anymore and I did not email him or call him anymore. I thought this was the end of it. Then a few months later Bret Shipp from WFAA shows up at my home and starts asking questions about the confrontation and about Cindy

Once I heard the name Cindy Burleson, it became clear why the reporter was there.

They have done everything they can think of to ruin my business, my reputation, and basically my life. They have accused me of anything they could think of, and have reported me to anyone they could come up with in an attempt to reek some sort of revenge against me and have me kicked off of eBay.
I was first contacted by Cindy Burleson in Feb. 2004. She had won one of my auctions for $1.50. She told me she was going to my house and pick up the item. I told her I do not let anyone from the internet come to my house. She insisted that she knew where I lived, and she was going to come over. She got really mad that I refused to allow her in my home. She began accusing me of bidding on my own auctions. The auction had started for $1, so she was accusing me of committing fraud to gain 50 cents ! She reported this to eBay, and emailed my customers with this ridiculous claim.
She then started calling me, and emailing obsessively, then she got her daughter, her boyfriend, and her friends to email me. I have received well over 1,000 emails from her and her friends/family. I got over 500 from them in one day alone. I did call her quite a few times to try to get her to stop, I threatened legal action, she just kept emailing and calling. I gave up, and stopped responding to her harassment in February 2004 and changed my phone number to stop her calls. That is when the real horror began. She is on a mission to do everything she can to effect my life, my business, and my family.
She took one of my emails to her and changed it to say that I was coming to kill her. She sent it to eBay so that they would cancel my account. I had a copy of the original email with the time, date, and ID numbers. I was able to prove to eBay that I did not do this, and they eventually reinstated my account. Meanwhile I was suspended for 30 days with no income because of this lie.
After all of these false allegations from Cindy and her daughter I began to suspect they were the ones up to no good on eBay, so I started to research her accounts and I found out Cindy would list items (such as Tiffany jewelry) and Lisa would bid against other bidders on the items to drive the price up! She had accused me of this when her and her daughter were the ones really doing it ! I showed eBay and eBay suspended the accounts. Neither Cindy Burleson or Lisa Taylor have been allowed on eBay since that time.
Cindy and Lisa both knew it was me who reported them and it only fueled their hatred towards me. Needless to say the story did not end there.
She handed out my home address and phone number to everyone she knows. They then started calling and driving by my house (then would call and/or email to say they had driven by) I filed a police report with the Johnson County Sheriff after they came by late one night in May 2004. I thought it would end after that but the worst was yet to come.
The 10news story states I was arrested for "harassment" and shows the mug shot from that ‘most recent’ arrest. The only reason I was arrested for harassment was because on 3-15-2004 Cindy Burleson filed a false police report against me with the Grand Prairie Texas police department. Apparently her story did not hold water, so action was not taken by the police. The following week 3-22-2004, Lisa goes back to Grand Prairie Texas police department and tells them a different story (someone must have told them their first report did not do it and what they would have to say in order for the Grand Prairie police to take action). A warrant was issued for me after the second report. I obtained copies of the 2 conflicting police reports and there is absolutely no mention of any ‘death threat’ in either of the 2 reports. In fact the reports say I had called 5 times, not the 30-40 she is claiming now. The strangest part of the 2 conflicting reports is that they were both taken by the same police officer. This is a matter of public record and can be verified by anyone through the Grand Prairie Police Department.
Now I ask you, if you were the police officer who took the initial report and knew full well it was false, why would you accept a second report with a different story from the same 2 people and allow them to use different names and addresses, but the same phone numbers ? Not to mention the fact that neither Cindy, her daughter, nor I resided in or around Grand Prairie at all.
Bret Shipp of WFAA was advised of all of this, but he made absolutely no mention of these facts I provided him with in the story they did on me. I guess the truth did not make for a ‘juicy’ story in Bret’s eyes.
I had no idea I even had a warrant for this until the night I was pulled over in my hometown of Cleburne a couple days after Christmas. I spent 5 days (including New Years Eve!) in jail before I could come up with the $5,000 bond they put on me ! Once the DA looked into the matter my bond was refunded in full and no charges were filed. I still spent 5 days in jail because of this woman's lies !
She has continued to harass me and my family. She said that she has been ‘terrorized’ but I have not emailed, called or initiated any contact with her since Feb. 2004. She and her daughter have continued this for almost 2 years now. Every so often I get some kind of strange email message from her. She tells me she likes my house, my car, my truck, and my wife. She has sent emails to my wife stating she has had sex with me in an effort to have my wife think I cheated on her. Both her and her daughter send me emails asking if I am having a nice day and that they love me, stuff like hugs and kisses and such. She even ran a criminal background check on me, got all of my personal information, then emailed to tell me she had this information. She emailed me in July 2005 saying she had driven by my house and saw me smoking in the front yard. She told me how ‘white trash’ she thought that was.
Now I ask you, if someone is harassing and ‘terrorizing’ you, why on earth would you be emailing them to antagonize them and drive by their home which is more than an hour away?
Cindy was frustrated that I was not responding to her emails and phone calls and proceeded to involve the Media and tell them the same bogus story she told eBay about me threatening her life. In fact, I found out about this whole ‘Ebay Bully’ story from HER!! She emailed me to show me what she had done.
After the 10news story aired I started receiving many emails from irate eBay users cussing me out left and right. I was lead into numerous chat forums and discussion boards which were discussing this ‘Ebay Bully’ story and even going as far as posting satellite images of my neighborhood and specifically pointing out my house on the image! Then eBay canceled my accounts telling me I had become a "legal liability” to them, and they could not allow me to conduct business on their site. This entire ordeal has become an ongoing nightmare from which I cannot seem to wake up.
I am an honest small business owner, just trying to make a living and take care of my home and family. I have been selling on eBay for 7 years. I have 1000’s of happy customers. It is unfortunate that I have lost my sole source of income due to a couple of persistent people with nothing better to do than to come up with ways to destroy my life. I now have been put out of business, and have no way to support myself or my family.
I have suffered loss of wages, false imprisonment, harassment, defamation of character, and now public humiliation at the hands of Cindy and her clan. I honestly cannot believe something like this could happen over a $1.50 auction. If it had not happened to me I still would not believe it.
The scariest part of this whole ordeal is that I have come to realize that Cindy Burleson is not going to stop. She is obsessed with me, and has made it her life’s mission to harass me and my family. If it happened to me, it could happen to anyone out there.

On July 16th, 2005 Dwayne Schimke, ebay user ‘Turnedtwo’ contacted me about a bike I was selling on eBay. He emailed saying that he wanted to come to my home and pick up the bike. I have clearly stated in all of my auctions that I do not allow people to pick up items. He admits himself that he ‘didn’t read the whole auction’ After a few emails were exchanged I told him I had blocked him from bidding, and asked him not to email me anymore. He was offended that I forbid him to bid on my auction, and continued to email me several more times after I had asked him to stop emailing me. Then I called his home, I used some choice words and told him to stop emailing me.
After that, he did not email me anymore and I did not email him or call him anymore. I thought this was the end of it. Then a few months later Bret Shipp from WFAA shows up at my home and starts asking questions about the confrontation and about Cindy
Burleson.
Once I heard the name Cindy Burleson, it became clear why the reporter was there.

I was first contacted by Cindy Burleson in Feb. 2004. She had won one of my auctions for $1.50. She told me she was going to my house and pick up the item. I told her I do not let anyone from the internet come to my house. She insisted that she knew where I lived, and she was going to come over. She got really mad that I refused to allow her in my home. She began accusing me of bidding on my own auctions. The auction had started for $1, so she was accusing me of committing fraud to gain 50 cents ! She reported this to eBay, and emailed my customers with this ridiculous claim.
She then started calling me, and emailing obsessively, then she got her daughter, her boyfriend, and her friends to email me. I have received well over 1,000 emails from her and her friends/family. I got over 500 from them in one day alone. I did call her quite a few times to try to get her to stop, I threatened legal action, she just kept emailing and calling. I gave up, and stopped responding to her harassment in February 2004 and changed my phone number to stop her calls. That is when the real horror began. She is on a mission to do everything she can to effect my life, my business, and my family.
She took one of my emails to her and changed it to say that I was coming to kill her. She sent it to eBay so that they would cancel my account. I had a copy of the original email with the time, date, and ID numbers. I was able to prove to eBay that I did not do this, and they eventually reinstated my account. Meanwhile I was suspended for 30 days with no income because of this lie.
After all of these false allegations from Cindy and her daughter I began to suspect they were the ones up to no good on eBay, so I started to research her accounts and I found out Cindy would list items (such as Tiffany jewelry) and Lisa would bid against other bidders on the items to drive the price up! She had accused me of this when her and her daughter were the ones really doing it ! I showed eBay and eBay suspended the accounts. She handed out my home address and phone number to everyone she knows. The 10news story states I was arrested for "harassment" and shows the mug shot from that ‘most recent’ arrest. The only reason I was arrested for harassment was because on 3-15-2004 Cindy Burleson filed a false police report against me with the Grand Prairie Texas police department. Apparently her story did not hold water, so action was not taken by the police. The following week 3-22-2004, Lisa goes back to Grand Prairie Texas police department and tells them a different story (someone must have told them their first report did not do it and what they would have to say in order for the Grand Prairie police to take action). A warrant was issued for me after the second report. I obtained copies of the 2 conflicting police reports and there is absolutely no mention of any ‘death threat’ in either of the 2 reports. In fact the reports say I had called 5 times, not the 30-40 she is claiming now. The strangest part of the 2 conflicting reports is that they were both taken by the same police officer. This is a matter of public record and can be verified by anyone through the Grand Prairie Police Department.
Now I ask you, if you were the police officer who took the initial report and knew full well it was false, why would you accept a second report with a different story from the same 2 people and allow them to use different names and addresses, but the same phone numbers ? Not to mention the fact that neither Cindy, her daughter, nor I resided in or around Grand Prairie at all.
Bret Shipp of WFAA was advised of all of this, but he made absolutely no mention of these facts I provided him with in the story they did on me. I guess the truth did not make for a ‘juicy’ story in Bret’s eyes.
I had no idea I even had a warrant for this until the night I was pulled over in my hometown of Cleburne a couple days after Christmas. I spent 5 days (including New Years Eve!) in jail before I could come up with the $5,000 bond they put on me ! Once the DA looked into the matter my bond was refunded in full and no charges were filed. I still spent 5 days in jail because of this woman's lies !
She has continued to harass me and my family. She said that she has been ‘terrorized’ but I have not emailed, called or initiated any contact with her since Feb. 2004. I was lead into numerous chat forums and discussion boards which were discussing this ‘Ebay Bully’ story and even going as far as posting satellite images of my neighborhood and specifically pointing out my house on the image! Then eBay canceled my accounts telling me I had become a "legal liability” to them, and they could not allow me to conduct business on their site. This entire ordeal has become an ongoing nightmare from which I cannot seem to wake up.
I am an honest small business owner, just trying to make a living and take care of my home and family. I have been selling on eBay for 7 years. I have 1000’s of happy customers. It is unfortunate that I have lost my sole source of income due to a couple of persistent people with nothing better to do than to come up with ways to destroy my life. I now have been put out of business, and have no way to support myself or my family.
I have suffered loss of wages, false imprisonment, harassment, defamation of character, and now public humiliation at the hands of Cindy and her clan. I honestly cannot believe something like this could happen over a $1.50 auction. If it had not happened to me I still would not believe it.

He called my home a questioned my minor child ( with his "kind" voice)"who are you, Dwayne's wife or girlfriend?" "Give him a message from me: tell him the next time he fuckes with me on the internet I'm gonna slap the shit out of his daughter!" There were 2 more phone calls left for us that were just over the top with the bad language and how he was going to hurt us. For more info on the man just google his name and you'll come up with the site that tells you about the other people that have had run ins with him dating back 3 years....

Tina I agree with you. A long winded response. He is continuing to go after us. I would love to speak at some point. MY DAUGHTER AND I DID NOTHING TO HIM. We simply ask a question of him. He called and cursed out my 10 year old son. The language was horrible. I could not believe he could say the C-NT word that many times in a sentence. I have never and would never go to this mans house nor have I ever considered it. I have not even thought about this man in quiet sometime until I heard from the news. The did the investigation and found we spoke the truth. I have gotten calls from all over the U.S. regarding the things he pulled. Anger management is what he needs. Maybe having him off ebay will save someones life someday. Tina thank you for standing up and speakingout. Having Frank on our bad side is something I din't want to relive but a necessary evil.

10:11AM - BUYER BEWARE
So on March 29th I purchased my cool vase from OpOrb.com, or I thought I did. Realizing my paypal account was still linked to my interact account, I quickly went to the seller's website and looked for some contact information. Not finding any, I used their online form and sent them an email stating that the email Paypal was linked to was no longer active, please send correspondence to my other email address.
Few days later... no response.
So I sent another email, now a week later.. Hey, I haven't heard anything from you, I never recieved any confirmation emails, please respond to me or I will be forced to report you to paypal.
Another few days passes...
So now I'm mad. I look up the domain on whois, get the email contact and phone number. On 4/13 I send yet another email to the seller through the 'kal@o-scope.com' email listed on the whois record. I also attempt to call the contact number on the whois record only to find it had been disconnected.
I wait another few days.. ok.. You had three weeks and never contacted me once.. never.. you're done.
So I report them to paypal, get my 40 back and they leave a nasty note about the fact that they had to ship to a PO Box so they don't have records to show the shipment but when they do they will be sure to send me an invoice for the merchandise.

I am sorry that our transaction had to come to this. Had only you responded a single one of my emails asking for a status, I would have never requested a refund through paypal. I had no confirmation of payment, no confirmation you had recieved my order, no shipping details, no phone number, no email address, nothing. Just a form on your website which you don't seem to answer.
In my paypal transaction, I specifically stated that if you were shipping to USPS to ship to the PO box, but any other carrier to ship to 9 Tamara Dr., Roosevelt NJ. If you wanted to use DHL so it would show on your statements, you simply had to ship it to the other address. Please do not blame the fact that I have a PO box on the fact that you never responded to a single email. The lack of any response from you is why I initated a fraud complaint,not because the merchandise hadn't shown up yet.
If you package does ever show up, although I don't know when it would because I have no details on the shipment at all, I'll be sure to refuse the package so you get your merchandise back. I've already purchased a similar vase somewhere else for half the price and no longer want your merchandise.

First of all, how can you claim to run a business and talk like that to customers? Is this how you react at every transaction that goes badly?
Secondly, SMTP provides no provision for if email is read or displayed, and emails won't hold up in a court of law because they are too easily spoofed.
Thirdly, perhaps you should check the "Contact Us" form on your website because if you never received any of my emails, then perhaps your form isn't working properly, in which case, you may have the same problem with future transactions.
Fourthly, you should update your phone number and contact email on your whois record for your domain name, because I also attempted to contact you through your kal@o-scope.com email address and tried to call you but the number had been disconnected.
Lastly, perhaps you should see a psychiatrist and get yourself on some anti-depressants, it's obvious by this email that you have serious mental problems.

Tina, after I asked Dwayne to stop emailing me and that we would not be doing any business together why would he continue to email me ? There is absolutely no reason for Dwayne to have continued to antagonize me and instigate a confrontation with me after I told him to stop. He thought the whole thing was real funny when he emailed me the words, "he, he, he". Dwayne started this whole thing and he knows it. I have the emails to prove it as well (which I am sure he did not show you).

I will GLADLY forward the emails I received from Cindy to ANYONE who asks. She has gone to great lengths to harass me. The police have seen these emails (with full headers) and have heard the recordings on my answering machine. It is only a matter of time before the TRUTH comes out.

The only thing I did wrong was allowing these liars to get to me. Tina is only defending her husband (and I can respect that), but he knows who started it and I can prove it to anyone by the emails he sent. I am sure Dwayne did not tell Tina about the emails he sent and probably erased them to cover his tracks, but I have those emails with full headers showing they orginated from the Schminke's computer. This can be verified through their ISP to be authentic.

She states, "Still sitting on the front porch smoking at night. That is so white trash.". This only further proves she has driven by my home on more than one occasion.
I have showed the police these emails from her and they realize what she is doing is against the law. It is only a matter of time before their investigation discovers who is the real 'crazy' one here.
and Bob, for what it's worth, I hope that if this ends up in a courtroom one day there can be a precedence set and put into effect to prevent this from ever happening to you or anyone else.

I heard the voice messages on the news, your crazy you need some help. In Cindy's emails there are not threats or mentions that she was the one that came by your house. Did she described your house? Plenty of eBay users have stories about situations when they clashed with someone at the other end of a transaction, whether it was over the terms, something misleading in the description or some other point. However, it appears that some eBay buyers have come across an amazingly angry eBay seller -- who seemed to turn nasty with no provocation at all. When potential buyers emailed him with questions, he turned around and sent them incredibly angry and threatening emails, and then started calling and harassing the buyers (who apparently left their phone numbers). The threatened buyers complained to the police, who did nothing, but a news organization tracked down the guy who claimed that if he got upset at potential buyers, it was only because they threatened him first. While it may not reach the level of showing up at an eBay seller's house with a gun, it's worth remembering that you never quite know who you're dealing with at the other end of an online transaction.

Me, God, and Cindy know the truth and that is all that matters for now.
Bob, you should realize that something like this can easily happen to you as well, so you should think more about what you are saying here.
I hope nothing like this ever happens to you, but in a way I sort of hope it will so you can understand what is going on here. I have been tormented and harassed for almost 2 years by these 2 nuts. I now get the feeling you are probably friends or associates of these 2 by the way you are defending their actions.

She described my house, my car, my truck, and my wife when she drove by and left a message on my recorder. The message the police heard. You MUST be there friend or something or you are simply to ignorant to see the truth. That is fine, there are people like you all over this world who simply cannot see the truth because of their own short sight. Believe what you want Bob, I know the truth and soon everyone else will. I bet once I sue and get a judgement against Cindy and her Daughter you still won't believe the truth. Shows how ignorant you really are.

Never met them, heard the tapes and saw the entries. You are CRAZY and need to get some help seriously. I have not seen anything leading me to believe the crap you say is true and they threatened your life. There are entries about you from alot of people on the web not just Cindy and her daughter. That many people can't make up the same stories. Where there is smoke there is fire. FIRE. You are the nut. I have not seen any entries from Cindy saying things about you only ones from you.

Frank, man, its really too bad you dont live in Florida with me. We've got this law now where apparently if someone is on or near your property, and they're giving you grief or making you feel threatened, you're fully within your rights to waste their asses and let God sort things out himself.
Other then that, I'd say it's too bad you're a smoker (losing 4 people in the family within six months to complications from it helps one to feel that way about smoking), but with a mad bitch like that hot on my tail, I'd be a smoker, alcholic, and who knows what else too.

Check out eBid (http://us.ebid.net). No listing fee. No reserve fee. Lower selling fee than eBay. Not as many listings yet as eBay but it's sure to grow as more and more people get fed up with eBay ripping them off.
